Terms of Service
1. What the Service is
Forget The Forms is a job-application assistant. It helps you fill out online job applications in a browser window the app opens on your computer, with its own browser profile, using facts you have entered and confirmed. It does not submit applications for you — it fills fields and then stops so that you review everything and click Submit yourself. You are the applicant and the person submitting each application.
The Service is offered only to individuals located in the United States. We do not offer, market, or support the Service outside the US. Before you create a free account or buy applications, the app asks you to tick a box saying you live in the United States (version 2.6 of the app asks only before you buy). That tick is your own statement; the app does not check where you are.
2. Honesty design (not a warranty)
The Service is designed to fill only answers that trace to information you confirmed, and to flag any field it cannot substantiate for your review rather than guessing. That is a description of how it is built. It is not a warranty, not a guarantee that any field is correct, and not one of the promises these Terms make, so the disclaimer in §9 applies to it. You are responsible for reviewing each application before you submit it and for the accuracy and truthfulness of everything you submit.
3. Your responsibilities
You agree that you will:
- Provide accurate information about yourself and keep it current.
- Review each application before submitting it, and not submit information you know to be false or misleading.
- Use the Service only for your own job applications.
- Comply with the terms of the third-party websites you apply through (see §4).
- Not use the Service to violate any law or any third party's rights.
You must be at least 18 years old and located in the United States to use the Service (see §1).
4. Third-party sites and scope
Job boards and applicant-tracking systems ("ATS") are operated by third parties under their own terms. The Service is currently designed to help fill the public, no-login application forms of Greenhouse, Lever, Recruitee, Pinpoint, Trakstar Hire, Homerun, Teamtailor, Comeet, JazzHR and CareerPlug. The app fills a job, and charges for it, only when the job's own link is on one of the systems just named, or is an address on the employer's own website that one of those systems gives as the place to apply (for example a Greenhouse form shown on the employer's own careers page). It also looks through jobs from other public sources, such as other job systems and public job feeds, and counts them among the jobs it looked through. Unless a job's own link is of the kind just described, it does not fill or charge for it and does not keep it in your Jobs list; one you had already started, queued, applied to, hidden or added a note to stays there, for you to apply to yourself. We have measured it filling Greenhouse, JazzHR and CareerPlug forms; on the others it may leave fields, or a whole form, for you to complete. We may add or remove systems at any time. It does not automate account creation, logins, or credential entry, and it does not submit on your behalf. Your use of any third-party site is governed by that site's own terms, which you are responsible for following. Login-gated application systems, such as Workday, are not offered. We are not affiliated with or endorsed by any of the companies named in this section; their names are used only to say which forms the Service works with.
5. No outcome guarantee
We do not guarantee interviews, offers, employment, or any application outcome. The Service is a tool that assists you; results depend on many factors outside our control.
6. Buying applications, and what a purchase gets you
- There is no subscription and no recurring charge. You buy a pack of applications once, through our payment processor, Stripe. Prices and pack sizes are 25 applications for $9.99, 60 for $19.99, or 150 for $39.99. Sales tax is added at checkout where we are registered to collect it. Nothing renews, so there is nothing to cancel; if you never buy again you are never charged again.
- One application buys one job, and going back to it never uses another. An application is spent when you ask us to start filling a specific job posting. Every later return to that same job on your account costs nothing, even when your balance has reached zero: answering a question it had to leave for you, reopening it, retrying after a crash. You are buying the job, not the attempt. The app reopens one job for you up to 10 more times on its own. After that it stops opening that job and tells you so; you can still finish the application by hand, and the page that tells you also has a button that resets the counter. Going back never costs an application, even when the app has stopped opening it. A job that was refunded to you is the one exception (see section 6.1). If our own job search already shows that a posting has been taken down, the app does not start it, whether you press Apply or run the queue, and nothing is spent. A job you have already started on that computer is not refused this way when you press Apply.
- Applications do not expire. Unused applications, bought or free, are lost if you delete your account (see the Privacy Policy, section 7).
- Automatic refunds. The application is put back, the first time one of these happens on a given job: the app opens the job and stops before typing anything, because the page has no application form on it at all or because what it reached is something the app does not fill; the form stops working after the app has started typing into it; or, with version 2.8.10 of the app or later, the job's page does not load on two runs at least an hour apart. An application can also be put back when we stop opening a whole website you had started a job on, though not every job is covered. Section 6.1 says exactly when each of these applies. What comes back is always an application, never money. A form that we filled but that rejected something, or that you decided not to submit, is not refunded, because you can return to it for free instead (within the reopen limit above). A job that was refunded is closed: opening it again is a new purchase. These are the only refunds we offer — see §6.1.
- A free allowance, used once. A free account, the kind you create with the free sign-up, includes 10 free applications. They are a lifetime allowance, not a monthly one: they do not reset, and there is one set per email address. An account that is created by buying a pack starts with that pack and does not get the 10. When a free account buys a pack, the free applications it has not used are kept: they are added to its balance, once, at that first purchase. Changing the email address on an account does not free the old address for another free allowance. When an account is deleted, or its address is changed to a different one, we keep a fingerprint of the address it left (not the address itself). A new account can still be opened on an address with such a fingerprint, but it starts with no free applications; you can buy applications for it. Giving an account its first address, or confirming the same address again, leaves no fingerprint, and capital letters, a plus tag, or dots in a Gmail address do not make a different address.
- A pace limit, not a paywall. We cap how many applications can run in one hour to keep the pace within what one person reviewing each application could produce. Hitting it costs nothing and loses nothing.
- A limit per employer. On one computer, the app starts applications at no more than 3 different jobs at the same employer on its own, so that no employer receives a burst of applications from you. A fourth is refused before anything is charged; you can still apply by hand, and the page that tells you has a button that resets the counter for that employer. Going back to a job you have already started there is not affected.
6.1 Refunds
- There is no money-back guarantee. There is no period during which you can hand back applications you have bought and be paid back, and no "no questions asked" refund of a purchase. The free applications that come with a free account (above) are there so you can see what the tool does before you pay for anything.
- Refunds are made by the software, and what comes back is an application, never money. There are two kinds: when the app could not get a job's form done (the next bullet), and when we stop opening a whole website (further below). Normally you do not have to ask for either; the next bullet says what to do when the first kind does not come through. If the application was paid for, the credit returns to your balance; if it was one of your free applications, it returns to your free allowance, or, if you have bought a pack since you started that job, to your balance.
- When the app could not get a job's form done. The application is put back when, on that job:
- the job's page opens but has no application form on it at all: a dead posting, or a page that turns out to be only a job description;
- the app stops before typing anything into it, because the application turns out to be on a system the app does not fill (such as Workday) or on a website we no longer open; because the site asks you to sign in or create an account; because the only Apply button would send a saved profile in one press, or pressing it tried to send a form, which the app stopped; or because the page lists other jobs too and the app cannot tell which Apply button belongs to this one;
- the form stops working after the app has started typing into it; or
- the job's page does not load at all. The app tries three times in the same run. If the page still does not load, nothing is put back yet: the job stays open, and trying it again later does not use another application. The application is put back when a later run, at least an hour after the first run that failed, also cannot load the page. If the page loads on a run in between, the hour starts again from the next run that fails. This case needs version 2.8.10 of the app or later: an older version does not tell our server that the page did not load, so with it such a run counts as a run that ends because of some other error (see below).
In the second case the app on your computer also marks the job as one you apply to yourself, and will not open it or charge for it again. In the third case the browser tab stays open and some boxes may already hold your answers, so check the form before you submit anything; opening the job again later is a new purchase, as for any refunded job. These refunds depend on the app reporting the job to our server. It tries up to three times (versions older than 2.8.10 try once), and in the second case it cannot report the job again afterwards. The app tells you what happened, in a notice on your Jobs page (or on the Queue page for a queued run) that stays until you dismiss it: that the application was put back; that the page did not load and trying again later will not use another application; that it could not confirm the refund with our server, in which case it may not have been put back and the number left on your Jobs page is the one to trust; or that a person needs to look at it. If an application that should have come back did not, write to disputes@forgettheforms.com (§14) and a person will look at it.
- Once per job, and a refunded job is closed. A job gets this refund once, whichever of the reasons above applied. After it, the job is marked refunded, and opening that same job again later is a new purchase: it uses another application. If a job you have bought again qualifies a second time, for any of these reasons, we write the report down, we do not put the application back automatically a second time, we tell you so, and we ask you to email disputes@forgettheforms.com so a person can look at it. In that second case the job stays open, so going back to it costs you nothing more.
- When we stop opening a whole website. We may stop opening a website altogether (for example because its owner asked us to). If you had started a job there, the application is put back automatically, once for that job, unless our records show you submitted it. Not every job is covered:
- it applies only when the job's own link (the address the app opens first, not wherever that page then leads) is on the website we stopped, and that link is on a job system the app fills; a job whose link is on an employer's own website is not covered;
- where one website carries many employers' jobs, it applies only if we stop that whole website, not when one employer there asks us to stop; where a job system gives each employer its own address, it applies only to the employers we list;
- our records must hold the job's link: version 2.6 of the app does not record it, so a job started with 2.6 is covered only if it was opened again with a newer version before we stopped the website.
This refund does not use up the refund described above.
- Nothing else is refunded automatically. None of these is refunded: a form we filled that then rejected something; a form you decided not to submit; a page that did not load on one run, or on runs less than an hour apart, until a later run qualifies as described above; a run that ends because of some other error; an application you never went back to; and an employer who never replied. In each of those cases the job stays open and going back to it never uses another application, which is what the application bought you. The limit of 10 reopens in section 6 still applies.
- If you have a question, or something has gone wrong and you need help, write to hello@forgettheforms.com. We would rather hear about it than not, and we will look at it. That is a conversation with a person; it is not a promise of a refund. If you want to dispute a charge, a refund or a decision we made, write to disputes@forgettheforms.com (§14).
- Your rights under the law are not limited by this section. Nothing in section 6 or 6.1 takes away a right the law gives you, including under New Jersey law, or your right to dispute a charge with your card issuer.
7. Acceptable use
Do not: resell or redistribute the Service; reverse-engineer, decompile, or attempt to extract the server-side logic; use automated means to abuse the Service; submit false information through it; or use it to apply on behalf of anyone other than yourself.
8. Intellectual property
The Service, including the client applications and the hosted service, is owned by us and licensed to you, not sold. You receive a limited, non-transferable, revocable license to use it per these Terms. You retain ownership of your own résumé and personal data.
9. Disclaimers
Apart from what these Terms promise, we provide the Service as it is and as it is available. We do not promise that it will run without interruptions or errors, that it will find any particular job, or that it will fill every field or every form (see §2 and §4). APART FROM WHAT THESE TERMS PROMISE, WE MAKE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. This section applies in New Jersey as written. Its exceptions are the ones listed in §10: it does not excuse fraud, gross negligence or willful misconduct, or liability for death or personal injury, and it takes nothing away from your rights under the New Jersey Consumer Fraud Act.
10. Limitation of liability
If we are liable to you for anything arising from the Service, our total liability for all claims is limited to $100 or the amount you paid us in the 12 months before the claim arose, whichever is greater, and we are not liable for indirect, incidental, special or consequential losses. These limits do not apply to liability for death or personal injury, for fraud, or for our gross negligence or willful misconduct, and they do not limit any right or remedy the New Jersey Consumer Fraud Act gives you. This section applies in New Jersey as written, with those exceptions.
11. No indemnity
We do not ask you to indemnify us or to pay our legal costs. You remain responsible, as §2 and §3 say, for reviewing each application and for what you choose to submit.
12. Suspension and termination
We may suspend or terminate accounts that violate these Terms. You may stop using the Service at any time and delete your account (see the Privacy Policy for data deletion).
13. Changes to these Terms
We may update these Terms; we will post the new effective date and, for material changes, notify you by email at the address on your account. The mail provider accepting a notice is not proof it reached your inbox, and an account with no email address on file cannot be emailed, so for such an account the effective date posted here is the only notice. Continued use after changes means you accept them.
14. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. These Terms contain no arbitration agreement and no class-action waiver, and they do not require you to bring a claim in any particular court.
Notices under these Terms, and any dispute about a charge, a refund or a decision we made, go to disputes@forgettheforms.com. Questions and requests for help go to hello@forgettheforms.com (§15).
